Sunrise Broadcasting “$1,000,000 Bracket Challenge” Contest 2014

RULES & REGULATIONS

 

No purchase necessary. Void where prohibited. All applicable federal, state and local regulations govern this contest.

 

These Official Rules are for the UPICKEM Men's College Basketball Tournament Contest (the "Contest"), which is a nationwide contest (including both the United States and Canada) Sponsored by Second Street Media Inc. ("Sponsor") with a Bonus Prize of $1,000,000 and for the Sunrise Broadcasting, LLC Bracket Challenge with prizes (Grand Prize of $500 cash, First Prize of a set of Tires up to $500 value, Second Prize of an Ipad mini worth $300 and Third Prize of a Slice of Life Pizza Pack worth $220) intended solely for players entering through a Sunrise Broadcasting, LLC radio station website who are at least 18 years of age and legal residents of North Carolina. 

 

This Contest is not intended to be used for gambling purposes. If it is determined that a participant is using the Contest for gambling purposes, he/she will be disqualified.

 

HOW TO ENTER: Participants must enter through one of Sunrise Broadcasting, LLC websites, www.ESPNWilmington.com, www.1045SunnyFM.com, www.Jammin999fm.com, www.modernrock987.com, and www.z1075.com. Participants will be able to complete a Basketball Bracket Form and submit it online. In the "Upfront" game, you pick the winner of each game of each round of the tournament prior to the start of the first full round of the tournament (i.e., the round of 64 teams).  Select the team that you predict will win each game of the Men's College Basketball Tournament and enter the score for the designated tie-breaker game. You may enter your picks until fifteen (15) minutes before the start of the first game of the first full round of the tournament (i.e., the round of 64 teams). You will not be required to pick the winners of the "First Four" play-in games.  Brackets will be made available for submission beginning on March 16, 2014 after 6:00p.m. EDT and all entries must be made before brackets close at the deadline of 11:45am on March 20, 2014.  No submissions will be accepted after that time.  The Men’s College Basketball Tournament starts March 20, 2014 at 12 noon EDT and runs through the championship game on April 7, 2014 ending at the conclusion of the game.   Any participant attempting to make team selections close to the deadline risks the chance of not getting his/her entry in on time.  Sunrise Broadcasting is not responsible for late entries, server congestion, faulty internet connections, etc., which may result in Sunrise Broadcasting not receiving a participant’s entry.

 

Limit one (1) entry per person.

HOW TO WIN; Bracket Challenge:

Each round of the tournament is worth up to 64 points. There are 6 rounds in the tournament worth up to 384 points. You will receive 2 points for each First Round game you pick correctly. You will receive 4 points for each Second Round game you pick correctly. You will receive 8 points for each Third Round game you pick correctly. You will receive 16 points for each Fourth Round game you pick correctly. You will receive 32 points for each Fifth Round game you pick correctly. You will receive 64 points for picking the winner of the Championship game. If a game is canceled, forfeited, or indefinitely suspended for any reason, that game shall not count for any participant and scores will be computed as if the game did not exist.

Grand Prize: The participant with the highest total score for all rounds combined will be deemed the Grand Prize winner ($500 cash, in the form of a check), subject to verification of eligibility.

In the event of a tie for the highest overall score, the computer takes those tied participants and applies the "Score Approximation Formula" outlined below to determine the Grand Prize winner.

Score Approximation Formula:

1. Subtract what the participant chose as the score for the winning team from the actual winning team's score and square this value.
2. Subtract what the participant chose as the score for the losing team from the actual losing team's score and squares this value.
3. Add the value from 1 and 2 above together to get the participant's "score approximation".
The participant with the lowest "Score Approximation" will be deemed the winner.

If there are still ties, the ties will be broken based on the following criteria in this order:

1. The most points earned in the Fifth Round.
2. The most points earned in the Fourth Round.
3. The most points earned in the Third Round.
4. The most points earned in the Second Round.
5. The most points earned in the First Round.
6. If there is still a tie the computer picks a random winner from the tied players.

National Bonus Prizes:

  • One (1) $1,000,000 cash prize will be awarded if a participant correctly picks all 63 games correctly. If more than one participant correctly picks all 63 games correctly, the $1,000,000 cash prize will be evenly divided and distributed among all participants who correctly picked all 63 games. Each participant can only win one of these cash prizes. So, for example, a participant who correctly picks all 63 games would receive the $1,000,000 cash prize, but not the $500 cash Grand Prize.

The bonus prize will not be awarded unless someone correctly picks all 63 games. Determination of cash prize winners, verification of eligibility, and compliance with these rules will be conducted by SCA Promotions, Inc., whose decision will be final. If won, the $1,000,000 prize will be awarded as an annuity.

First Prize:The First Prize is a set of Tires up to $500 value from Black’s Tire.

 

Second Prize:The Second Prize is an Ipad mini worth $300 sponsored by Buffalo Wild Wings-Wilmington.

 

Third Prize:  The Third Prize is a Slice of Life Pizza Pack worth $220 including a $200 Slice of Life Gift Card.

 

PRIZES, VALUES & ODDS OF WINNING: One (1) Bonus Prize, One (1) Grand Prize, one (1) First Prize one (1) Second Prize and one (1) Third Prize will be offered in the Contest. Prizes will only be awarded upon winner validation and verification by Second Street and Sunrise Broadcasting.  Odds of winning depend on the number of eligible entries received and on the relative ability of entrants to correctly predict the winners of games.

 

Neither Sunrise Broadcasting LLC nor Capitol Broadcasting Company, Inc., assumes any liability or responsibility in connection with the use of any prize awarded hereunder nor in connection with any warranty or representation therewith. Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. each reserves the right to substitute prizes of equal or greater value in the event that the scheduled prize becomes unavailable.

 

PRIZE REDEMPTION/CLAIM/RELEASES: Winner(s), if any will be notified by phone, email, and/or mail and will be required to sign and return an Affidavit of Eligibility and Publicity/Liability release, within three (3) days of notification.  The Affidavit of Eligibility must be complete and include each winner’s social security.  Information in the winner’s Affidavit of Eligibility must be correct and must mirror the information provided in the winner’s registration on the bracket website, or winner is disqualified.  If winner(s) can not be contacted, is ineligible, fails to claim a prize or fails to return the completed and executed Affidavit/Release as required, or if the Prize Notification or prize is returned as undeliverable, the prize will be forfeited.  No unclaimed prizes will be awarded.  

 

Each winner is responsible for all federal, state and local taxes and may be required to complete an IRS form W-9. Sponsors reserve the right to withhold prizes until completed form W-9 is received.  For prizes valued at $600 or greater, winner must provide his or her Social Security Number for tax purposes.  Prizes may be considered income, and any and all taxes associated with prizes are responsibility of winners.  Only the actual winner will be able to claim prizes. Each winner will be required to execute a prize acknowledgement and release form, an affidavit of eligibility and liability/publicity release when claiming prize. Compliance with all regulations is the responsibility of the winner.

Each winner, by acceptance of a prize, agrees to release Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc., their sponsors, advertising and third-party promotion companies from any and all liability for claims, actions or proceedings for injuries or damages sustained in connection with the receipt, ownership or use of the prize or while traveling to, preparing for or participating in any contest-related or prize-related activity, including participation in Bracket Challenge. Except where prohibited, by playing the contest, or by winning, participants have granted Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. the right to publicize their name, photograph or likeness, voice and biographical details without compensation or opportunity for review, and have accepted and agreed to be bound by these rules. Names and likenesses of Bracket Challenge winner(s) may be used by Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. and Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc.’s designee(s) for promotional purposes without further compensation to Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. or the Bracket Challenge winners(s).

 

ELIGIBILITY: To be eligible to participate, you must be 18 years of age or older at the time of entry and a legal North Carolina resident. Limit one winner per household.  Limit one winner per family.  Prizes are non-transferable. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. Proof of age, identity, and eligibility must be furnished to Sponsors upon request.  All entry form information must be complete and accurate.  Sponsors will not award a prize to anyone not meeting eligibility requirements at the time of entry.

 

Employees of Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc., agents, subsidiaries, representatives, sponsors, affiliates, distributors, prize suppliers, successors, and assignees of Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc., advertising agencies and promotional companies involved in this Bracket Challenge, as well as family and household members of same, shall be ineligible to participate in the Bracket Challenge and shall be ineligible for any prize.  Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. reserves the right to disqualify any entrant if the contest rules are not followed. No groups, clubs, or organizations may participate in this contest, or reproduce or distribute any portion of these rules to its members. Any attempt by an entrant or any other individual to damage or interfere with any entry method, online service or website or undermine the legitimate operation of the Bracket Challenge will disqualify the individual responsible and is a violation of criminal and civil laws and should such an attempt be made, Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. reserve the right to seek damages and/or other remedies from any such person to the full extent permitted by law.  Any use of robotic, macro, automatic, programmed or like methods of play will void all such plays, and may subject that participant to disqualification. Sponsors reserve the right at their sole discretion, to disqualify any individual (and all of his or her submissions) who tampers with the submission process.

 

LIABILITY: Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. are not responsible for problems associated with communications hardware or software, television transmission, radio transmission, cable transmission, satellite transmission, phone lines, wireless or wired systems, handsets, or networks, Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, or other Internet interruptions or malfunctions or for any technical or other difficulties which may prohibit, prevent, or interfere with the transmission of television or radio signals to all or limited geographic areas during any aspect of the contest or which may interfere with a participant's ability to login, participate, call, text, register or submit an entry by any approved method, electrical outages, natural disasters or acts of man or God that are beyond the control of Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc.  

 

Neither Sponsors nor Promotion Parties are responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Neither Sponsors nor Promotion Parties are responsible for injury or damage to any participant’s or any other person’s computer or property related to or resulting from participating in this Contest. Should any portion of Contest be, in the Sponsors’ sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsors, corrupt or impair administration, security, fairness or proper play of this Contest, or Contest plays, Sponsors reserves the right at their sole discretion to suspend, modify or terminate the Contest.

 

Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. EACH disclaimS any warranty of merchantability, warranty of fitness, and any other implied warranty.NEITHER SunriseBroadcasting LLC NOR Capitol Broadcasting Company, Inc IS RESPONSIBLE FOR CANCELLATIONS, POSTPONEMENTS, OR DELAYS.  WINNERS, QUALIFIERS, AND ENTRANTS AGREE, EXCEPT WHERE PROHIBITED BY LAW, TO RELEASE AND DISCHARGE, HOLD HARMLESS AND INDEMNIFY Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc., AND ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THE BRACKET CHALLENGE, FROM ANY AND ALL TAX LIABILITY THAT MAY BE IMPOSED OR ASSOCIATED WITH RECEIPT OR USE OF THE PRIZES, AND FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS, AND LIABILITY FOR ANY DAMAGES, EXPENSES, FEES, INJURY OR LOSSES (INCLUDING PERSONAL INJURY OR DEATH) SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, OR USE OR MISUSE OF ANY PRIZE OR WHILE TRAVELING TO, PREPARING FOR, OR PARTICIPATING IN ANY CONTEST-RELATED OR PRIZE-RELATED ACTIVITY.

 

All decisions are made by the management of Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. and are final.
